Agreement to Terms

By accessing or using Artbase Studio (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Artbase Studio provides artists and creators with tools to:

  • Create and manage online storefronts
  • Manage product catalogs and inventory
  • Process and track orders
  • Send email marketing campaigns to subscribers
  • View analytics and business insights

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload or transmit viruses, malware, or harmful code
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm other users
  • Sell prohibited or illegal products
  • Spam customers or subscribers
  • Attempt to interfere with or disrupt the Service
  • Access the Service through automated means without permission
  • Reverse engineer or attempt to extract source code

Content and Intellectual Property

Your Content

You retain all rights to the content you upload to the Service (products, images, descriptions, etc.). By uploading content, you grant us a license to use, store, and display that content solely for the purpose of providing the Service to you.

Our Intellectual Property

The Service, including its design, features, and functionality, is owned by Artbase Studio and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

Payment and Fees

Access to certain features of the Service may require payment of fees. By subscribing to a paid plan:

  • You authorize us to charge your payment method for applicable fees
  • Fees are billed in advance on a recurring basis
  • All fees are non-refundable unless otherwise stated
  • We may change our fees with 30 days' notice
  • You are responsible for all taxes associated with your use of the Service

Transactions and Orders

When customers purchase products through your storefront:

  • You are responsible for fulfilling orders and providing customer service
  • You must accurately represent your products
  • You must honor the prices and terms displayed on your storefront
  • You are responsible for handling refunds and disputes with customers
  • We are not a party to transactions between you and your customers

Email Marketing

When using our email marketing features, you agree to:

  • Comply with all applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Only email people who have given explicit consent
  • Include a clear unsubscribe option in all emails
  • Honor unsubscribe requests promptly
  • Not send misleading or deceptive content

Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or interruptions.

Termination

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. You may cancel your account at any time through your account settings. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your data after a reasonable retention period
  • You remain responsible for any outstanding fees

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTBASE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

Indemnification

You agree to indemnify and hold harmless Artbase Studio from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Artbase Studio operates, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
